HOA's and nuisance abatement

Hi Everyone, I just got a call from Zach (cc’d) in Iowa City with some questions about nuisance abatements, notices of violation, and general processes for HOA’s. For issues like nuisance vegetation or snow removal enforcement, they are sending notices of violation to the HOA owner/manager, the individual property owner, and the occupant. For one nuisance vegetation case, he could be sending dozens of notices. How are you all handling nuisance enforcement at HOA’s? Do you notice all parties or just the park ownership group? For what it’s worth, Des Moines is more or less in line with how Iowa City is currently handling it but if one of you has figured out a better way to handle these it’d be very helpful to hear about. This is from Adam Coyle: City of West Des Moines.rnWe handle ours on a situational basis… rnrn- If the violation exists on property owned by the HOA and it is not obvious who is causing the violation or if the violation exists throughout the HOA owned property, then I will just post one notice on the entrance to the property and mail a regular and certified notice to all addresses listed on the Secretary of State site for the HOA.rnrn- If the violation exists on property owned by the HOA, but it is obvious that one person is causing the violation, I will mail notices to both the HOA and the unit owner and post on the door of the unit owner.rnrn- If the violation exists on an individual owners land, but an HOA exists, I will post a notice on the door of the individual property owner and only mail copies of the notice to the individual property owner. rnrnThe owner of the property where the violation exists, whether it be a private owner or and HOA always gets a notice from us (they are ultimately responsible for what is happening on their property). If we can reasonably determine someone else is causing the problem, we give them a notice as well. rnrn
